Vertex was retained
by a General Contractor's Surety, who was named as a defendant in a
construction defect matter involving multiple carriers, the developer,
architect, general contractor, eight subcontractors and one supplier.
Construction defects were related to masonry, structural concrete, EIFS,
lightweight concrete on balconies and walkways, membrane roofing, windows and
building envelope assemblies. Vertex managed repairs of certain defects during
the warranty period on behalf of the Surety. Vertex investigated the cause
& origin of certain defects and successfully supported subrogation of
certain claims on behalf of our client. Vertex provided support and expertise
during litigation that ultimately resulted in a favorable settlement for our
client

Phase I Environmental Site Assessment (ESA)

Vertex performed Phase I ESAs at a portfolio of sixty-seven properties located across the country. Properties assessed included retail and office developments, high-rise apartment and condominium buildings in cities including New York, NY, Los Angeles, CA, and Phoenix, AZ.
In addition to standard Phase I ESA scope items, Vertex also assessed potential concerns regarding radon, asbestos-containing materials, lead-based paint, and microbial growth. Vertex provided the client with detailed reports of individual sites and a comprehensive table summarizing the portfolio as a whole. Vertex completed the portfolio within the client-directed three week turn-around time.

Vertex obtained and reviewed environmental database reports and historical sources for sixty-six multi-tenant residential properties located across the country, including a number of redevelopment sites located in former industrial and downtown areas. The client was provided with a spreadsheet summarizing the findings for individual sites and identifying properties of potential environmental concern.

Phase I Environmental Site Assessment (ESA)

Vertex performed Phase I ESAs at a portfolio of twelve properties in Florida. Properties assessed included former agricultural rangeland and citrus groves, a former golf course, and undeveloped properties ranging from 50 to 1,200-acres in size. Properties also included derelict structures, areas of dumping, and various above-ground storage tanks (ASTs) associated with water well pump stations. In addition to standard Phase I ESA scope items, Vertex also assessed the potential for endangered species and wetland areas on the undeveloped sites, as well as the potential for impacts associated with historic pesticide use.
Gainesville, FL
Due Diligence & Remediation Management
4.5 Acre Development
Vertex managed the due diligence, remedial investigation and remediation at a 4.5 acre
development site in Gainesville, Florida. Vertex submitted a Remedial Action Plan (RAP) to the
Alachua County Environmental Protection Department of (ACEPD) to excavate approximately
3,000 tons of impacted soil and to complete groundwater dewatering and on site treatment.
Vertex was successful in providing groundwater modeling information to the ACEPD in order to
acquire a No Further Action (NFA) for the off site impacts, and the on site remediation was also
successful in reducing on-site groundwater concentrations below Groundwater Clean-up Target
Levels (GCTLs). As part of the turn-key service, Vertex completed all asbestos contracting
services, remediation, environmental oversight and building demolition services under a single
contract with a single point of contact for the client.

Water Damage & Mold Assessment
Vertex assessed the extent of water damage and mold impacts throughout an unoccupied, framed 3-story apartment building. It was determined that water intrusion was caused by a rain event that occurred during construction when the roof and walls were not yet complete. Following assessment, Vertex developed a Mold Remediation Specification for submittal to the remediation contractors. Additionally, Vertex solicited competitive abatement proposals. We documented baseline moisture conditions, and monitored the remedial progress to ensure compliance with work specifications and industry standard abatement guidelines. Upon completion of remediation, Vertex performed the post-remedial visual clearance inspections.
